IMI.com Registrant Prevails in Jury Trial

At the end of 2017, I wrote about the IMI.com UDRP decision. Shortly after the decision in favor of the complainant was published, I labeled it “stunning.” It looks like the registrant of the domain name filed a lawsuit shortly after losing the UDRP, and from what I can tell, it looks like he won. The case is still ongoing (more on that below).

The court docket is quite long, and it looks like it made it all the way to a jury trial. The jurors were asked several questions, with the two most important (and non-contingent ones) below:

John Berryhill Comments About Enom Subpoena

Some domain investors received an email from Enom’s legal department yesterday notifying them about a subpoena that was received by the company. Enom sends these emails when the recipient’s information was found during an internal (Enom) search for documents related to the subpoena. If an investor received this email, it could be related to a Scratch Foundation lawsuit that was written about by Andrew Allemann earlier this year.

PornHub / YouPorn URS Decision is Surprising

A company called Licensing IP International S.à r.l. filed a URS complaint at the National Arbitration Forum against several new gTLD domain names. The complainant operates a number of popular adult websites, including PornHub, YouPorn, Tube8, RedTube, PornMD, and SexTube. The domain names subject to the URS filing include pornhub.plus, pornhubteen.top, pornmd.icu, pornohub.bid, redtube.bike, redtube.ink, redtube.vet, sextube.ink, tube8.blue, tube8.wtf, xxxyouporn.top, and youporn.guru.

Celgene Files Lawsuit After It Lost a UDRP with RDNH

In February of this year, I wrote about Celgene’s UDRP filing against the CellGene.com domain name. The three member WIPO UDRP panel not only ruled against Celgene, but the panel found that the UDRP was a case of Reverse Domain Name Hijacking (RDNH). The domain registrant was permitted to keep the domain name.

This Mamar.com UDRP Sucks (Updated)

A UDRP was filed against the Mamar.com domain name at the World Intellectual Property Organization (WIPO). According to a couple of Spanish to English dictionaries I checked, the word mamar means “to suckle” – as in breastfeed. The UDRP is WIPO Case D2019-1210. The UDRP was filed by an entity called Mamar Group LTD.

UDRP Filed Against ABC.net (Updated)

I was just made aware of a mind boggling UDRP filing. The Australian Broadcasting Corporation has filed a UDRP for the ABC.net domain name. The filing was made at the World Intellectual Property Organization (WIPO), and it is WIPO Case D2019-1181.
