UDRP Filed Against Circus.com (Updated)

A UDRP has been filed against Circus.com at the World Intellectual Property Organization (WIPO). The complainant in the case is listed as Circus Belgium. The case is WIPO Case D2016-1208.

When I first read about the UDRP on Domain Name Wire, I had to a double take. Circus.com is a very old dictionary .com domain name. In fact, Circus.com was created back in 1993! Based on some Whois searching I did at DomainTools, the domain name has been owned by the current owner for a long time. Because of corporate name changes and privacy, I could not pinpoint how long but I believe it is at least

A UDRP has been filed against the Loading.com domain name at the World Intellectual Property Organization (WIPO). The complainant for this case is listed as Javier Narvaez Segura / Grupo Loading Systems S.L. This is WIPO Case D2016-1199.

Loading.com is a dictionary keyword .com domain name owned by Mrs Jello, LLC, the company that was founded by the late Igal Lichtman, who passed away in 2013. I believe the company continues to be operated by his family. DomainTools shows that Loading.com was created in July of 1998. Historical Whois records from DomainTools show that Mrs Jello has owned the domain name since at least 2009. Loading.com is not currently resolving for me, although it appears that the domain name was once parked with a PPC landing page. I do not see any public sales history for Loading.com in NameBio.

A UDRP has been filed against Bostonian.com. The complainant in this case is  C & J Clark America Inc., which I believe  owns  the Bostonian shoe brand. The UDRP was filed at the World Intellectual Property Organization, and it is WIPO Case D2016-1159.

Bostonian.com is an old domain name having been created in 1995. I don’t regularly see UDRP cases involving domain names that are over 20 years old. I did a Whois history search, and the oldest historical Whois record at DomainTools is from 2000. At that point, the admin contact was someone in Washington. Although the Whois information was private for quite some time, the current registrant has the same last name as the admin contact  in 2000 and is also located in Washington. My  guess is that

Koozie is a Trademark: Company Gets Koozie.com in UDRP

Drinking a cold beer outside on a hot Summer day is something I enjoy, and a koozie helps keep my beer cold. Did you know that the term “Koozie” is actually a trademark rather than a generic term? A recent UDRP decision sheds light on this and shows the issue with buying generic-sounding domain names that are actually trademarks.

BIC Corporation of Clearwater, Florida filed a UDRP at the World Intellectual Property Organization for BottleKoozies.com and Koozie.com. It is WIPO case No. D2016-0557. Citing its “Koozie” trademarks, the complainant prevailed in this single panelist UDRP decision, and the domain names will be transferred to the complainant. The respondent did not reply to the UDRP.

I did not even realize that “koozie” is a trademark, as I’ve always thought that is just what they are called. There are a ton of domain names registered with the word “koozie” in them, and I would imagine there are plenty of domain name owners who have no idea that “koozie” is protected in the same manner as Microsoft or Realtor.

Interestingly, the “koozie” trademark apparently lapsed at some point, and that may have protected the domain name owner to some degree due to the registration date of the domain name. The panelist’s discussion of this issue was what I found most interesting in this decision:

XMY.com UDRP

A UDRP has been filed against the three letter .com domain name XMY.com. The UDRP was filed at the World Intellectual Property Organization, and it is WIPO Case D2016-0961. The complainant appears to be a Chinese entity and is listed as 福建省华世伟业信息科技股份.

XMY.com is currently registered at eName to a entity that appears to be based in China. The landing page for XMY.com is in Chinese, but I can see an English sentence on the page that says, “This domain name is for sale.” XMY.com has a creation date of January 19, 2000.

I did a few historical Whois searches at DomainTools, and it looks like this domain name may have changed hands a few times since 2012. From what I see, the registrants since that time all appear to be based in China.

I did a Google search for the complainant, as listed in the WIPO database, and I couldn’t find much information. This is likely due to my lack of knowledge of the Chinese language. As such, I am not sure what the complainant’s connection to XMY.com is or why it believes it has rights to the XMY.com domain name.

My guess is that the UDRP decision will be rendered in Chinese, and we will have to rely on Google Translate to get an idea of the facts of this case. I’ll be keeping my eye on this UDRP proceeding since it involves a high value 3 letter .com domain name.

Update: According to UDRPSearch.com, the complaint was denied, although the decision has not yet been published. I will update this if there is anything noteworthy in the decision discussion.

UDRP Filed Against CPM.com (Updated)

According to UDRPSearch.com, a UDRP was filed at the National Arbitration Forum (NAF) for the valuable CPM.com domain name. NAF does not publish the name of the complainant before the decision is rendered, so I am not sure who filed the dispute. The UDRP is case #1672836, and it was commenced yesterday.

CPM.com is one of the oldest domain names in existence, with a creation date of November 11, 1990. The earliest historical Whois listing on DomainTools is from 2000, and it lists a company called
