ICA Issues Important Statement Following Devex.org UDRP Decision

Zak Muscovitch, interim General Counsel of the Internet Commerce Association (ICA), took the rare step of issuing a statement on behalf of the ICA following a controversial UDRP decision that could impact future UDRP decisions should the same wrong approach be applied. You’ll want to read the ICA’s statement on CircleID urging UDRP panelists to follow the policy rather than seemingly set their own guidelines. The Devex.org decision could be one cited by future complainants, and I am glad to see the ICA call it out.

For domain investors, the most concerning aspect of the decision can be found in the section discussing registration and use in bad faith. The decision states:

“Respondent’s apparent belief at the time it registered <devex.org> that someone, at some time in the future, might cultivate trademark rights in DEVEX which Respondent could then exploit obviates any requirement that to succeed under the UDRP the respondent must have contemplated a particular trademark holder and/or a particular trademark.”

What this seems like to me is that the panelist is saying that if you register a domain name today and a company uses that keyword as a trademark ten years from now, they could win a UDRP complaint. I have always been under the impression that if a domain owner creates a new term – let’s say

Domain Brokers Comment on Cryptocurrency Domain Names

It’s pretty clear 2017 has been the year of cryptocurrencies, and in the domain industry, it seems that cryptocurrency-related domain names have been big sellers. Every day, it seems like domain names that have “coin” or “crypto” in them are selling at auction or selling via aftermarket platforms. There are even more cryptocurrency domain names that are sold privately, some for big money. Even Bloomberg published an article about the trend a month ago.

Because of the popularity of these domain names, I reached out to some of the top domain name brokers to ask for their take on these types of domain names. Specifically, I asked if they have any comments about the market for crypto-related domain names that I can share in a blog post. Several brokers responded, and here are their thoughts on the current state of the market.

Page Howe Talks Emoji Domains on Vice News

A few weeks ago, I shared a video of Page How and Darryl Lopes talking about emoji domain names. I always thought it would be neat to video a couple of people from the domain industry having an interesting conversation about domain names, and this is the kind of discussion I envisioned. Someone shared another video about emoji domain names featuring Page Howe, and this one had a much wider audience.

Two Firms to Host Free GDPR Webinar

I think changes to privacy laws are going to pose an additional challenge to those who invest in domain names. More specifically, the EU’s General Data Protection Regulation (GDPR) will make it more difficult for domain investors to see who owns domain names, and it will become more challenging to get in touch with the domain owners to make an offer for the domain name.

A domain management firm called Brandsight and a domain name and brand protection firm called Yellow Brand Protection are co-hosting a free webinar to discuss these upcoming changes.
